Moses Austin (October 4, 1761 – June 10, 1821) was an American businessman and pioneer who played a large part in the development of the lead industry in the early United States , especially in southwest Virginia and Missouri. He was the father of Stephen F. Austin , one of the earliest American settlers of Texas , which was at the time part of Mexico .

The tiny village around the mines became known as " Austinville ", and Moses came to be known as

532-456: A banker. Financier and co-director Stephen Girard was troubled at Jones' promotion, concerned that he could never provide disinterested leadership for the bank, and businessman John Jacob Astor doubted Jones' ability to wield the bank's regulatory powers effectively. Jones extended the institution's resources liberally in accordance with the post-war "national exuberance", generating large dividends for its stockholders. His administration of

Without such countersignature they shall not be valid, except as provided under section 65(2). The concept of lèse-majesté ( lesa-majestad ) exists in Spanish jurisprudence , which

798-450: A down payment of one-fourth of the total cost and the balance in four annual payments. Failure to pay in full in five years meant forfeiture. Public land debt ballooned from $ 3 million in 1815 to $ 17 million in 1818. The U.S. Treasury accepted land payments in the form of banknotes issued by western and southern state banks. These institutions often lacked sufficient specie reserves to back up their vastly over-extended credit. As long as

Despite Franco's alliance with the Carlists, Franco appointed Juan Carlos I de Borbón as his successor, who is credited with presiding over Spain's transition from dictatorship to democracy by fully endorsing political reforms. Impatient with

1064-604: A land grant and permission to settle three hundred families in Texas. On Austin's return trip, he became ill, and he died in June 1821, shortly after arriving back in Missouri. His son Stephen F. Austin carried out his colonization plan several years later, and led the three hundred families to what became the first Anglo-American settlement in Texas. In 1885, the legality of Austin's Spanish property claims were settled posthumously by

1197-724: A mansion called Durham Hall, named for his birth town of Durham, Connecticut . Moses Austin attempted various economic ventures before his plans to settle in Texas came to fruition. Austin failed to successfully maintain the St. Louis Bank and his financial situation suffered from unfavorable shipment deals. Austin's desperation reached a climax in 1820 when a Missouri sheriff threatened to break down his door to collect past debts. Austin's son, Stephen F. Austin , also continued to seek employment in Mississippi and Arkansas to help his poor financial situation. In November 1820, Austin learned that

India enjoyed not only a longer growing season and lower cost of freight to Britain, but also more cotton-devoted land than the entire Louisiana Purchase. Tench Coxe , a Pennsylvanian political economist and delegate to the Continental Congress, warned of the "substantial evil" exhibited in the rivalry created by foreign competition. Coxe has been dubbed by many as

1463-535: A measure to prevent a future crisis. Banking regulation was seen as primarily a state responsibility, and several states passed regulations in the years following the panic that required banks to maintain certain fixed ratios of capital to ensure their ability to convert to specie. A further effect of the Panic of 1819 was increased support for protective tariffs for American industry. Vocal protectionists, such as Philadelphia printer Mathew Carey , blamed free trade for

The central bank's direct influence on inflationary lending was limited to those chartered banks whose paper currency

2394-536: A span of four years from 1816 to 1820. Employing these "stern procedures", Cheves placed the bank on sound footing in early 1819. A leading critic of the Second Bank of the United States during the Bank War would observe: "The bank was saved, and the people were ruined." Despite the Second Bank of the United States' inept management under the Jones-Cheves administrations, it was not the causative agent in

2527-586: A sudden recovery in European agricultural production in 1817, led to widespread bankruptcies and mass unemployment. The financial disaster and recession provoked popular resentment against banking and business enterprise, along with a general belief that federal government economic policy was fundamentally flawed. Americans, many for the first time, became politically engaged so as to defend their local economic interests. The New Republicans and their American System —tariff protection, internal improvements , and

2660-528: A “Form of Contract for Emigration to Texas” which detailed the obligations of each member joining the settlement in Texas. Austin required emigrants to help build community structures. He also ordered the settlers to own a “Spanish carbine”, a type of gun, to protect the settlement. Austin's relationship with the settlers he recruited was not one of mutual respect, but rather he employed the settlers. Austin contracted his settlers to work from their departure in May, until

According to the Spanish Ministry of Justice , nobility and grandee titles are created by the "sovereign grace of the king", and may be passed on to the recipient's heirs, who may not sell the title. Although he is nominally chief executive, his acts are not valid unless countersigned by a minister, who then assumes political and legal responsibility for the act in question. This legal convention mirrors the concept of sovereign immunity which evolved in similar constitutional monarchies. The legal concept of sovereign immunity evolved into other aspects of immunity law in similar liberal democracies , such as parliamentary immunity , judicial immunity , and qualified immunity in

3059-706: Is the crime or offense violating the dignity of the head-of-state or the State itself. According to Article 56 of the 1978 Constitution the monarch and the dignity of the Spanish State are one and the same: "The King is Head of State, the symbol of its unity and permanence". Breaching Spain's lèse-majesté laws may carry fines and up to two years in prison. The concept is within the same legal sphere as legislation prohibiting flag desecration in other democratic countries. Additionally, lèse-majesté extends to any foreign heads-of-state visiting Spain, and other members of

During the Napoleonic Wars , the French Emperor Napoleon Bonaparte forced Ferdinand VII to abdicate in 1808, and the Bourbons became a focus of popular resistance against French rule. As a general rule, most titles are now inherited by absolute Cognatic Primogeniture (as of 2006), in which the first born inherits all titles regardless of gender. However, a title holder may designate his successor, Succession by Assignment , or disperse his titles among his children – with the eldest getting the highest-ranking title, Succession by Distribution . This outdated reward system granted tracts of land to immigrants who pledged their allegiance to the Spanish crown. After returning from successful negotiations in San Antonio , Austin returned to Missouri to recruit settlers for his new settlement. In April, he created

After the Virginia lead business failed, Moses skipped out to avoid imprisonment and the consequences of debt, which was then customary for debtors in the U.S. under traditional English law (now being developed for U.S. federal and state codes), and looked toward the rich lead deposits in Missouri , then

4655-495: The "father of the American cotton industry". Cotton value began to waver in 1818, threatening to burst the speculative bubble. A general contraction in lending was indicated in response to these developments in Europe. In August 1818, with credit dangerously overextended, BUS branch offices began to reject all state-chartered banknotes under the direction of William Jones. Exceptions were made for notes used as revenue payments to

4788-790: The 15th century, the marriage between Isabella I of Castile and Ferdinand II of Aragon , both members of the House of Trastámara , known as the Catholic Monarchs , united two important kingdoms of the Iberian Peninsula . Each kingdom retained its basic structure. The last pretender of the crown of the Byzantine Empire , Andreas Palaiologos , who styled himself as "Emperor of Constantinople", bestowed his imperial title to Ferdinand II of Aragon and Isabella I of Castile in his last testament, dated 7 April 1502, although

In 1820, Austin traveled to the Presidio San Antonio de Béxar in Spanish Texas and presented a plan to colonize Texas with Anglo-Americans to Governor Antonio María Martínez . In 1821, the governor asked Austin's friend, Erasmo Seguín , to give him the news that he had been awarded

5187-887: The Bank of the United States assumed its regulatory functions. Under these "ominous terms" the bank was launched—its operational success already at risk. The eighteen branch offices of the SBUS in 1817 operated with little oversight from the Philadelphia headquarters, nor from the U.S. Treasury. This policy stemmed in part from a social philosophy that prevailed among Republicans during the Era of Good Feelings , which wished to Republicanize credit practices and encourage westward migration. The United States government encouraged settlement of these lands by offering public land at $ 2 per acre (160-acre minimum), though auctioneering tended to retard sales and raised prices slightly. The historical processes contributing to the panic and depression, which were beyond the bank's control, included the European market fluctuations, obstruction from the numerous private banks to federal regulations and the widespread ignorance among lenders and borrowers as to the new financial mechanisms that made possible the credit expansion and land boom. The bank's role

6118-485: The Panic, these precarious economic conditions—a manifestation of "rapid expansion, speculation and wildcat banking " —prevailed in the South and West, where the economic collapse would be most severe. By July 1818, the Second Bank of the United States had demand liabilities exceeding $ 22.4 million, whereas its specie fund stood at $ 2.4 million—a 10:1 ratio and double the 5:1 ratio considered sustainable. 6384-577: The Relief for Public Land Debtors Act. The bill allowed debtors who owed money on land purchased from the government to keep the part of land they had already paid for and relinquish the remaining amount. It further extended the schedule of payments by several years, with a discount for quick payment. With the exception of New England states, most of the country strongly supported the measure. Many state legislatures, particularly in rural western states, passed extra relief measures for debtors. Another response to

6517-640: The Republican party leadership. The Democratic-Republican party found itself in control of the national government with the collapse of the Federalist party at the end of the War of 1812. Some of the traditional Jeffersonian agrarian precepts—especially strict construction of the Constitution—had softened due to difficulties during the war arising from a lack of infrastructure, unregulated banking and

6650-491: The SBUS branch offices in the North and East, to fuel another cycle of excessive lending. The SBUS branch banks, emulating their wildcat counterparts, injected so much of their own paper money into circulation that they negated their regulatory capacity: they could not with impunity demand specie payments from state banks that held public deposits without being presented with their own script for convertibility in return. In January 1816, he introduced a bill of incorporation in the House of Representatives for a government bank (which would become the Second Bank of

7049-402: The Spanish State domestically and internationally, all the while aiming to maintain a professionally non-partisan yet independent monarchy. The Crown of Spain ( la Corona de España ), with its roots in the Visigothic kingdom from the 5th century and subsequent successor states, is recognized in Title II The Crown , Articles 56 through 65 of the Spanish Constitution of 1978 . The viceroy (vice-king) and the Audiencias were the effective administrators of royal policy. In 1505,

The unification of Spain is marked from this date, though the Spanish kingdoms continued past that date. The SBUS, in turn, anticipated that the state banks which had issued the paper money would, upon demand, redeem their currency with gold and silver—"convertibility"—reimbursing the government bank. In order to remain solvent, the state banks would, ideally, constrain their lending of paper money—however profitable—so as not to allow the SBUS to become

Opposition to the Bank came from two fronts: the orthodox Tertium quids (or "Old Republicans") who reflexively regarded an enlargement of the central government as an assault on personal liberty and a violation of Jeffersonian agrarianism, and state-chartered private banking interests, who favored paper money but considered federal regulation of local banking operations to be anti-Republican. These ideologies and interests would be arrayed against

8379-605: The bank resonated with Secretary Crawford's lenient policy with regard to public land receipts in the form of chartered-bank script when specie was scarce nationally. The Second Bank of the United States began operations in January 1817 as fiscal agent of the United States Treasury. After February 20, 1817, the SBUS was scheduled to begin to receive all government revenue in legal tender as required by its charter. Hard money shortages prevailed because U.S. imports exceeded exports and Peruvian and Mexican gold and silver sources failed to replenish specie reserves. Due to this scarcity,

They requested permission to bring three hundred families to a port in Texas. Most importantly, Austin insisted that the settlers were former subjects of Spain and would be willing to defend the land against foreign enemies. Austin convinced Spain to reinstate

8778-447: The constitution is obeyed. Lastly, the king swears to respect the rights of Spanish citizens and of the self-governing communities. The Prince of Asturias, upon reaching the age of majority, in addition to any regent(s) upon assuming the office, swears the same oath as that of the king along with a further oath of loyalty to the monarch. The 1978 constitution affirmed the role of the King of Spain as the living personification and embodiment of the Spanish nation and a symbol of Spain's enduring unity and permanence and is also invested as the "arbitrator and the moderator" of Spanish institutions. Constitutionally, the sovereign is the head of state and commander-in-chief of

9576-518: The exclusion of liberals, gradually eroded popular support for the Spanish monarchy. With the Pragmatic Sanction of 1830 , Ferdinand set aside the Salic law , introduced by Philip V, that prohibited women from becoming sovereigns of Spain. Thereby, as had been customary before the arrival of the Bourbons, Ferdinand VII's eldest daughter Isabella became his heiress presumptive . Opponents of
