The IEEPA authorizes the president to declare the existence of an "unusual and extraordinary threat... to the national security, foreign policy, or economy of the United States" that originates "in whole or substantial part outside the United States." It further authorizes the president, after such a declaration, to block transactions and freeze assets to deal with

Sections are often divided into (from largest to smallest) subsections, paragraphs, subparagraphs, clauses, subclauses, items, and subitems. Congress, by convention, names a particular subdivision of a section according to its largest element. For example, "subsection (c)(3)(B)(iv)"

348-616: A CIA agent assigned to the FBI's international terrorism division, emailed his superiors at the CIA's Counterterrorism Center (CTC) requesting permission to inform the FBI that Hazmi was in the country and that Mihdhar had a U.S. visa. The CIA never responded. The same day, Margarette Gillespie, an FBI analyst working in the CTC, was told to review material about the Malaysia meeting. She was not told of

Marwan al-Shehhi arrived at the end of May 2000, while Atta arrived on June 3, 2000, and Jarrah arrived on June 27, 2000. Bin al-Shibh applied several times for a visa to the United States, but as a Yemeni, he was rejected out of concerns he would overstay his visa. Bin al-Shibh stayed in Hamburg, providing coordination between Atta and Mohammed. The three Hamburg cell members all took pilot training in South Florida at Huffman Aviation . In

580-566: A few theories that 9/11 was selected by the hijackers as the date of the attack because it resembled 9-1-1 , the phone number used to report emergencies in the United States. However, Lawrence Wright wrote that the hijackers chose the date when John III Sobieski , the King of Poland and Grand Duke of Lithuania , began the battle that turned back the Ottoman Empire 's Muslim armies that were attempting to capture Vienna in 1683. Vienna

696-572: A group of men from Hamburg , Germany, arrived in Afghanistan. The group included Mohamed Atta , Marwan al-Shehhi , Ziad Jarrah , and Ramzi bin al-Shibh. Bin Laden selected these men because they were educated, could speak English, and had experience living in the West. New recruits were routinely screened for special skills and al-Qaeda leaders consequently discovered that Hani Hanjour already had

812-485: A limited time, such as most appropriation acts or budget laws, which apply only for a single fiscal year . If these limited provisions are significant, however, they may be printed as "notes" underneath related sections of the Code. The codification is based on the content of the laws, however, not the vehicle by which they are adopted; so, for instance, if an appropriations act contains substantive, permanent provisions (as

928-500: A matter for the FBI". By late June, senior counter-terrorism official Richard Clarke and CIA director George Tenet were "convinced that a major series of attacks was about to come", although the CIA believed the attacks would likely occur in Saudi Arabia or Israel. In early July, Clarke put domestic agencies on "full alert", telling them, "Something spectacular is going to happen here, and it's going to happen soon". He asked

1044-477: A new Title 52 , which has not been enacted into positive law. When sections are repealed, their text is deleted and replaced by a note summarizing what used to be there. This is so that lawyers reading old cases can understand what the cases are talking about. As a result, some portions of the Code consist entirely of empty chapters full of historical notes. For example, Title 8, Chapter 7 is labeled "Exclusion of Chinese". This contains historical notes relating to

1160-465: A period of transition, having just relocated back to Afghanistan from Sudan . The 1998 African embassy bombings and bin Laden's February 1998 fatwā marked a turning point of al-Qaeda's terrorist operation, as bin Laden became intent on attacking the United States. In late 1998 or early 1999, bin Laden approved Mohammed to go forward with organizing the plot. Atef provided operational support, including target selections and helping arrange travel for

So we tell the Americans as people and we tell the mothers of soldiers and American mothers in general that if they value their lives and the lives of their children, to find a nationalistic government that will look after their interests and not the interests of the Jews . The continuation of tyranny will bring the fight to America, as [the 1993 World Trade Center bomber] Ramzi [Yousef] yourself and others did. This

These annotated versions contain notes following each section of the law, which organize and summarize court decisions, law review articles, and other authorities that pertain to the code section, and may also include uncodified provisions that are part of the Public Laws. The publishers of these versions frequently issue supplements (in hard copy format as pocket parts ) that contain newly enacted laws, which may not yet have appeared in an official published version of

1508-566: A section in the Code. To cite any particular section, it is enough to know its title and section numbers. According to one legal style manual, a sample citation would be " Privacy Act of 1974 , 5 U.S.C.   § 552a (2006)", read aloud as "Title five, United States Code, section five fifty-two A" or simply "five USC five fifty-two A". Some section numbers consist of awkward-sounding combinations of letters, hyphens, and numerals. They are especially prevalent in Title 42. A typical example

1624-513: A series of provisions together as a means of addressing a social or governmental problem; those provisions often fall in different logical areas of the Code. For example, an Act providing relief for family farms might affect items in Title 7 (Agriculture), Title 26 (Tax), and Title 43 ( Public Lands ). When the Act is codified, its various provisions might well be placed in different parts of those various Titles. Traces of this process are generally found in

1856-470: A telephone call mentioning the meeting, Mihdhar, and the name "Nawaf" (Hazmi); while the agency feared "Something nefarious might be afoot", it took no further action. The CIA had already been alerted by Saudi intelligence about Mihdhar and Hazmi being Al-Qaeda members. A CIA team broke into Mihdhar's Dubai hotel room and discovered that Mihdhar had a U.S. visa. While Alec Station alerted intelligence agencies worldwide, it did not share this information with

1972-414: Is common for lawyers to refer to a " Chapter 11 bankruptcy " or a "Subchapter S corporation " (often shortened to " S corporation "). In the context of federal statutes, the word "title" has two slightly different meanings. It can refer to the highest subdivision of the Code itself, but it can also refer to the highest subdivision of an Act of Congress which subsequently becomes part of an existing title of

2088-556: Is my message to the American people: to look for a serious government that looks out for their interests and does not attack others, their lands, or their honor. My word to American journalists is not to ask why we did that but to ask what their government has done that forced us to defend ourselves. Bin Laden orchestrated the September 11 attacks. He initially denied involvement, but later recanted his denial. Al Jazeera broadcast

The United States Code is the result of an effort to make finding relevant and effective statutes simpler by reorganizing them by subject matter, and eliminating expired and amended sections. On a day-to-day basis, very few lawyers cross-reference the Code to the Statutes at Large . Attempting to capitalize on the possibility that the text of the United States Code can differ from the United States Statutes at Large , Bancroft-Whitney for many years published a series of volumes known as United States Code Service (USCS), which used

2784-523: Is that the original drafters of the Code in 1926 failed to foresee the explosive growth of federal legislation directed to "The Public Health and Welfare" (as Title 42 is literally titled) and did not fashion statutory classifications and section numbering schemes that could readily accommodate such expansion. Title 42 grew in size from 6 chapters and 106 sections in 1926 to over 160 chapters and 7,000 sections as of 1999. In the case of RFRA, Congress was trying to squeeze a new act into Title 42 between Chapter 21A (ending at 42 U.S.C.   § 2000aa-12 ) and Chapter 22 (beginning at 42 U.S.C.   § 2001 ). In 2004 and 2010, bin Laden again connected the September 11 attacks with U.S. support of Israel, although most of the letters expressed bin Laden's disdain for President Bush and bin Laden's hope to "destroy and bankrupt"

A number of other online versions are freely available, such as Cornell 's Legal Information Institute . Practicing lawyers who can afford them almost always use an annotated version of

8236-508: The ability to regulate or prohibit communication that "does not involve a transfer of anything of value"; imports or exports of information or any informational materials; and transactions incidental to travel. Donations intended to relieve human suffering, such as food, clothing or medicine are also excluded unless the President specifically finds their inclusion necessary. Congress enacted the IEEPA in 1977 to clarify and restrict presidential power during times of declared national emergency under

8352-500: The actual date). Though authorized by statute, these changes do not constitute positive law . The authority for the material in the United States Code comes from its enactment through the legislative process and not from its presentation in the Code. For example, the United States Code omitted 12 U.S.C.   § 92 for decades, apparently because it was thought to have been repealed. In its 1993 ruling in U.S. National Bank of Oregon v. Independent Insurance Agents of America ,

8468-471: The actual text of the United States Statutes at Large ; the series is now published by the Michie Company after Bancroft-Whitney parent Thomson Corporation divested the title as a condition of acquiring West . Only "general and permanent" laws are codified in the United States Code; the Code does not usually include provisions that apply only to a limited number of people (a private law ) or for

8584-487: The app and, as also suggested by ByteDance in court documents pertaining to its lawsuit to overturn the order, a ticket reservation prank waged by some users of the video platform that depressed attendance for a campaign rally he held in Tulsa, Oklahoma that June. The executive order was blocked by federal courts in two separate cases on grounds that the sanctions likely violated IEEPA's informational materials exemption (under

8700-863: The attacks include the National September 11 Memorial & Museum in New York City, the Pentagon Memorial in Arlington County, Virginia, and the Flight 93 National Memorial at the Pennsylvania crash site. In 1996, Osama bin Laden of the Islamist militant organization al-Qaeda issued his first fatwā , which declared war against the United States and demanded the expulsion of all American soldiers from

8816-845: The attacks and said they were carried out because: The events that affected my soul in a direct way started in 1982 when America permitted the Israelis to invade Lebanon and the American Sixth Fleet helped them in that. This bombardment began and many were killed and injured and others were terrorised and displaced. I couldn't forget those moving scenes, blood and severed limbs, women and children sprawled everywhere. Houses were destroyed along with their occupants, high rises demolished over their residents, rockets raining down on our home without mercy...As I looked at those demolished towers in Lebanon, it entered my mind that we should punish

8932-468: The attacks as retaliatory strikes against American atrocities against Muslims across the world. He also maintained that the attacks were not directed against women and children, asserting that the targets of the strikes were symbols of America's "economic and military power". In bin Laden's November 2002 Letter to the American People , he identified al-Qaeda's motives for the attacks: After

9048-408: The attacks, along with Ramzi bin al-Shibh. The 2004 9/11 Commission Report determined that the animosity which Mohammed, the principal architect of the 9/11 attacks, felt towards the United States had stemmed from his "violent disagreement with U.S. foreign policy favoring Israel". Mohammed was also an adviser and financier of the 1993 World Trade Center bombing and the uncle of Ramzi Yousef ,

9164-402: The attacks, bin Laden and Ayman al-Zawahiri released additional recordings , some of which repeated the above reasons. Two relevant publications were bin Laden's 2002 Letter to the American People and a 2004 videotape by bin Laden. [...] those young men, for whom God has cleared the way, didn't set out to kill children, but rather attacked the biggest centre of military power in the world,

9280-469: The attacks, said: It has become clear that the West in general and America in particular have an unspeakable hatred for Islam.   ... It is the hatred of crusaders . Terrorism against America deserves to be praised because it was a response to injustice, aimed at forcing America to stop its support for Israel, which kills our people.   ... We say that the end of the United States is imminent, whether Bin Laden or his followers are alive or dead, for

9396-522: The awakening of the Muslim ummah [nation] has occurred.   ... It is important to hit the economy (of the United States), which is the base of its military power...If the economy is hit they will become reoccupied. Shortly before the 2004 U.S. presidential election , bin Laden used a taped statement to publicly acknowledge al-Qaeda's involvement in the attacks. He admitted his direct link to

9512-427: The blocking subject a chance to effectively respond to the allegations in court. Executing these blocking actions led to a series of legal cases challenging federal authority to indefinitely prevent charitable organizations from accessing their assets held in the United States. President Donald Trump used the IEEPA extensively, sanctioning more than 3,700 entities and invoking 11 national emergency declarations (out of

9628-462: The court's investigation into allegations of war crimes committed by the U.S. and Israel in Afghanistan and the Palestinian territories , respectively. Critics considered the order an effort to intimidate ICC civil servants from proceeding with its investigation and accused the administration of targeting the two prosecutors, both of African origin, based on their race. The U.S. District Court for

9744-504: The deadliest terrorist attack in history as well as the deadliest incident for firefighters and law enforcement personnel in American history, killing 343 and 72 members, respectively. The loss of life stemming from the impact of Flight 11 made it the most lethal multi-plane crash in aviation history followed by the death toll incurred by Flight 175. The destruction of the World Trade Center and its environs seriously harmed

9860-598: The deadliest terrorist attack in history. In response to the attacks, the United States waged the multi-decade global war on terror to eliminate hostile groups deemed terrorist organizations, as well as the foreign governments purported to support them. Ringleader Mohamed Atta flew American Airlines Flight 11 into the North Tower of the World Trade Center complex in Lower Manhattan at 8:46 a.m. Seventeen minutes later, United Airlines Flight 175 hit

9976-585: The emergency declaration power itself. A 1973 Senate investigation found (in Senate Report 93-549 ) that four declared emergencies remained in effect: the 1933 banking crisis with respect to the hoarding of gold, a 1950 emergency with respect to the Korean War , a 1970 emergency regarding the postal workers strike , and a 1971 emergency in response to the government's deteriorating economic and fiscal conditions. Congress terminated these emergencies with

10092-546: The enacted laws and publishes them as the United States Statutes at Large . By law, the text of the Statutes at Large is "legal evidence" of the laws enacted by Congress. Slip laws are also competent evidence. The Statutes at Large , however, is not a convenient tool for legal research. It is arranged strictly in chronological order; statutes addressing related topics may be scattered across many volumes, and are not consolidated with later amendments. Statutes often repeal or amend earlier laws, and extensive cross-referencing

10208-505: The flight, five hijackers armed with boxcutters took over the plane, injuring at least three people (and possibly killing one) before forcing their way into the cockpit. The terrorists also displayed an apparent explosive and sprayed mace into the cabin, to frighten the hostages into submission and further hinder resistance. Back at Logan, United Airlines Flight 175 took off at 8:14 a.m. Hundreds of miles southwest at Dulles International Airport , American Airlines Flight 77 left

10324-531: The gate at 8:00 a.m., the plane was running 42 minutes late. At 8:46 a.m., Flight 11 was deliberately crashed into the north face of the World Trade Center's North Tower between the 93rd and 99th floors. The initial presumption by many was that it was an accident. At 8:51 a.m., American Airlines Flight 77 was also taken over by five hijackers who forcibly entered the cockpit 31 minutes after take-off. Although they were equipped with knives, there were no reports of anyone on board being stabbed, nor did

10440-751: The hijackers. Bin Laden overruled Mohammed, rejecting potential targets such as the U.S. Bank Tower in Los Angeles for lack of time. Bin Laden provided leadership and financial support and was involved in selecting participants. He initially selected Nawaf al-Hazmi and Khalid al-Mihdhar , both experienced jihadists who had fought in Bosnia . Hazmi and Mihdhar arrived in the United States in mid-January 2000. In early 2000, Hazmi and Mihdhar took flying lessons in San Diego, California. Both spoke little English, performed poorly in flying lessons, and eventually served as secondary "muscle" hijackers. In late 1999,

10556-477: The laws in effect as of December 1, 1873. Congress re-enacted a corrected version in 1878. The 1874 version of the Revised Statutes were enacted as positive law, but the 1878 version was not and subsequent enactments of Congress were not incorporated into the official code, so that over time researchers once again had to delve through many volumes of the Statutes at Large . According to the preface to

10672-565: The lead bomber in that attack. In late 1994, Mohammed and Yousef moved on to plan a new terrorist attack called the Bojinka plot planned for January 1995. Despite a failure and Yousef's capture by U.S. forces the following month, the Bojinka plot would influence the later 9/11 attacks. In "Substitution for Testimony of Khalid Sheikh Mohammed" from the trial of Zacarias Moussaoui , five people are identified as having been completely aware of

10788-685: The national security threat of illegal immigration from Mexico into the United States. As part of an ongoing trade war with China , on August 24, 2019, Trump tweeted that he "hereby ordered" U.S. companies to start looking at alternatives to China on the basis of claimed powers under IEEPA. Trump, however, did not formally declare an emergency as required by IEEPA. In September 2020, the Trump administration sanctioned and imposed visa restrictions on two International Criminal Court (ICC) officials, prosecutor Fatou Bensouda and Jurisdiction Complementarity and Cooperation Division Director Phakiso Mochochoko , over

10904-559: The non-exhaustive list of exempted materials was illustrative in nature, inferring that unlisted materials not yet invented or in wide use at the time of its passage would be prohibited from being subject to sanctions or other regulation under both acts. Following the September 11, 2001 terrorist attacks , President George W. Bush issued Executive Order 13224 under the IEEPA to block the assets of terrorist organizations. The President delegated blocking authority to federal agencies led by

11020-403: The operation's details. They are bin Laden, Khalid Sheikh Mohammed, Ramzi bin al-Shibh , Abu Turab al-Urduni and Mohammed Atef . Osama bin Laden's declaration of a holy war against the United States, and a 1998 fatwā signed by bin Laden and others that called for the killing of Americans, are seen by investigators as evidence of his motivation. In November 2001, bin Laden defended

11136-519: The oppressor in kind and that we should destroy towers in America so that they taste some of what we tasted and so that they be deterred from killing our women and children. And that day, it was confirmed to me that oppression and the intentional killing of innocent women and children is a deliberate American policy. Destruction is freedom and democracy, while resistance is terrorism and intolerance. Bin Laden personally directed his followers to attack

11252-463: The order of subdivision runs: Title – Subtitle – Chapter – Subchapter – Part – Subpart – Section – Subsection – Paragraph – Subparagraph – Clause – Subclause – Item – Subitem. The "Section" division is the core organizational component of the Code, and the "Title" division is always the largest division of the Code. Which intermediate levels between Title and Section appear, if any, varies from Title to Title. For example, in Title 38 (Veteran's Benefits),

11368-432: The order runs Title – Part – Chapter – Subchapter – Section. The word "title" in this context is roughly akin to a printed "volume", although many of the larger titles span multiple volumes. Similarly, no particular size or length is associated with other subdivisions; a section might run several pages in print, or just a sentence or two. Some subdivisions within particular titles acquire meaning of their own; for example, it

11484-618: The organization-including Abu Hafs the Mauritanian , Sheikh Saeed al Masri , and Sayf al Adl . One senior al Qaeda operative claims to recall Bin Ladin arguing that attacks against the United States needed to be carried out immediately to support insurgency in the Israeli-occupied territories and protest the presence of U.S. forces in Saudi Arabia. —  9/11 Commission Report , p. 251 On July 13, Tom Wilshire,

11600-552: The original amendment's First Amendment exemptions to include newer and forthcoming mediums (including intangible items such as television broadcasts and methods of personal communication), further clarifying that the President's emergency sanction powers under the IEEPA and TWEA cannot be used with regard to any information or informational materials, regardless of their format or medium, or whether they are intended for personal or commercial use. The updated language also clarified that

11716-471: The participant's presence in the U.S. The CIA gave Gillespie surveillance photos of Mihdhar and Hazmi from the meeting to show to FBI counterterrorism but did not tell her their significance. The Intelink database informed her not to share intelligence material with criminal investigators. When shown the photos, the FBI refused more details on their significance, and they were not given Mihdhar's date of birth or passport number. In late August 2001, Gillespie told

11832-538: The restrictions would have become applicable to TikTok unless it was sold to an American company within 45 days of the executive order's issuance. Observers (including Trump administration critics and many TikTok users) raised First Amendment concerns with the executive order and suggested that, while national security concerns were cited to justify them, the sanctions were prompted by the administration's hostile relations toward China in general and retaliation against TikTok in particular for certain anti-Trump content hosted by

11948-588: The runway at 8:20 a.m. Flight 175's journey proceeded normally for 28 minutes until 8:42 am, when a group of five hijacked the plane, murdering both pilots and stabbing several crew members before assuming control of the aircraft. These hijackers also used bomb threats to instil fear into the passengers and crew, also spraying chemical weapons to disable any opposition. Concurrently, United Airlines Flight 93 departed from Newark International Airport in New Jersey ; originally scheduled to pull away from

12064-546: The spring of 2001, the secondary hijackers began arriving in the United States. In July 2001, Atta met with bin al-Shibh in Tarragona , Catalonia, Spain, where they coordinated details of the plot, including final target selection. Bin al-Shibh passed along bin Laden's wish for the attacks to be carried out as soon as possible. Some of the hijackers received passports from corrupt Saudi officials who were family members or used fraudulent passports to gain entry. There have been

12180-551: The task. The Code generally contains only those Acts of Congress, or statutes, designated as public laws. The Code itself does not include Executive Orders or other executive-branch documents related to the statutes, or rules promulgated by the courts. However, such related material is sometimes contained in notes to relevant statutory sections or in appendices. The Code does not include statutes designated at enactment as private laws, nor statutes that are considered temporary in nature, such as appropriations. These laws are included in

12296-428: The threat. In the event of an actual attack on the United States, the president can also confiscate property connected with a country, group, or person that aided in the attack. IEEPA falls under the provisions of the National Emergencies Act (NEA) , which means that an emergency declared under the act must be renewed annually to remain in effect. The authority given to the President under the IEEPA does not grant them

12412-424: The title of the Code itself the force of law. This process makes that title of the United States Code "legal evidence" of the law in force. Where a title has been enacted into positive law, a court may neither permit nor require proof of the underlying original Acts of Congress. The distinction between enacted and unenacted titles is largely academic because the Code is nearly always accurate. The United States Code

12528-550: The world, which spreads mischief throughout the world. — Osama Bin Laden's interview with Tayseer Allouni , October 21, 2001 As an adherent of Islam , bin Laden believed that non-Muslims are forbidden from having a permanent presence in the Arabian Peninsula . In 1996, bin Laden issued a fatwā calling for American troops to leave Saudi Arabia. One analysis of suicide terrorism suggested that without U.S. troops in Saudi Arabia, Al-Qaeda likely would not have been able to get people to commit to suicide missions. In

12644-530: The year of last enactment. The Office of Law Revision Counsel (LRC) has produced draft text for three additional titles of federal law. The subject matter of these proposed titles exists today in one or several existing titles. The LRC announced an "editorial reclassification" of the federal laws governing voting and elections that went into effect on September 1, 2014. This reclassification involved moving various laws previously classified in Titles 2 and 42 into

12760-499: Was a radical who had traveled to Pakistan, and the INS arrested him for overstaying his French visa. Their request to search his laptop was denied by FBI headquarters due to the lack of probable cause . The failures in intelligence-sharing were attributed to 1995 Justice Department policies limiting intelligence-sharing, combined with CIA and NSA reluctance to reveal "sensitive sources and methods" such as tapped phones. Testifying before

12876-412: Was about to happen. None of that information got to me or the White House. [...] by July [2001], with word spreading of a coming attack, a schism emerged among the senior leadership of al Qaeda. Several senior members reportedly agreed with Mullah Omar . Those who reportedly sided with bin Ladin included Atef , Sulayman Abu Ghayth , and KSM . But those said to have opposed him were weighty figures in

12992-590: Was deliberately crashed by co-pilot Gameel Al-Batouti , killing over 200 passengers. "This is how the idea of 9/11 was conceived and developed in my head, and that is when we began the planning" bin Laden continued, adding that no one but Abu Hafs and Abu al-Khair knew about it at the time. The 9/11 Commission Report identified Khalid Sheikh Mohammed as the architect of 9/11, but he is not mentioned in bin Laden's notes. The attacks were conceived by Khalid Sheikh Mohammed , who first presented it to Osama bin Laden in 1996. At that time, bin Laden and Al-Qaeda were in

13108-607: Was killed during a U.S. military raid on his compound in Abbottabad, Pakistan . The War in Afghanistan continued for another eight years until the agreement was made in February 2020 for American and NATO troops to withdraw from the country . Excluding the hijackers, the attacks killed 2,977 people, injured thousands more and gave rise to substantial long-term health consequences while also causing at least $ 10   billion in infrastructure and property damage. It remains

13224-527: Was last printed in 2018. Both the LRC and the GPO offer electronic versions of the Code to the public. The LRC electronic version used to be as much as 18 months behind current legislation, but as of 2014 it is one of the most current versions available online. The United States Code is available from the LRC at uscode.house.gov in both HTML and XML bulk formats. The "United States Legislative Markup" (USLM) schema of

13340-638: Was likely much higher than 3,000, but did not give a specific estimate. In 2008, the Heritage Foundation published a report that put the number at a minimum of 4,450. When staff for a task force of the U.S. House Judiciary Committee asked the Congressional Research Service (CRS) to update its 2008 calculation of criminal offenses in the USC in 2013, the CRS responded that they lack the manpower and resources to accomplish

13456-809: Was the seat of the Holy Roman Empire and Habsburg monarchy , both major powers in Europe at the time. For Osama bin Laden, this was a date when the West gained some dominance over Islam, and by attacking on this date, he hoped to make a step in Islam "winning" the war for worldwide power and influence. In late 1999, al-Qaeda associate Walid bin Attash ("Khallad") contacted Mihdhar and told him to meet in Kuala Lumpur , Malaysia; Hazmi and Abu Bara al Yemeni would also be in attendance. The NSA intercepted
